ORDER RESTRUCTURING THE MOTIONS DEPARTMENT
The Motions Department previously has been established pursuant to ORS 2.570. Pursuant to new subsection (2) of ORS 2.570, as adopted by Section 1 of Senate Bill 262 (2009 Or Laws, ch. 231), the Motions Department shall consist of two judges, except as otherwise provided in this order.
The members of the Motions Department shall consist of a presiding judge, who shall be designated by the Chief Judge; a second judge, who will be the Chief Judge or his or her designee; and a third judge, who will be a member at such times as necessary to break a tie vote for the disposition of a matter before the department. At the Chief Judge’s discretion, the third judge also may sit for the purpose of participating in a published decision of the department.
In the ordinary course, the Chief Judge's designee, if any, as the second judge will not be a presiding judge of another department and shall serve a three-month term, at which time the judge will be succeeded by another judge.
The Chief Judge from time to time will designate the second and third judges of the Motions Department.
This order is effective January 1, 2010.
